Terms and Conditions

These terms and conditions govern the provision of garden management services by ABS Horticulture (ABN to be confirmed) to you, the client. By engaging our services, you agree to be bound by these terms.
1. Service Schedule
1.1. ABS Horticulture operates on a monthly service schedule. Your garden will be visited once per month as part of the agreed program, unless otherwise specified in your service agreement.
1.2. We will contact you via SMS the weekend prior to your scheduled visit to confirm the date and approximate time of arrival. Any acknowledgement that you have received this message is appreciated.
1.3. Service times are subject to change due to weather conditions, scheduling adjustments, or other operational factors. We will make reasonable efforts to notify you of any changes.
2. Property Access
2.1. The client must ensure that ABS Horticulture has access to the property on the scheduled service date. All doors, gates, and access points must remain unlocked or keys must be made available.
2.2. You do not need to be present during our visit. We are fully capable of servicing your garden with or without the occupant at home.
2.3. If we are unable to access the property on the scheduled date due to locked gates, restricted entry, or other access issues not communicated in advance, the visit will be counted as completed and no refund or credit will apply.
3. Service Inclusions
3.1. The agreed-upon quote is a fixed price and is all-inclusive. Your monthly service includes:
- Selective fertilisers, herbicides, and pesticides
- Removal and disposal of green waste
- Professional horticultural expertise in plant management
- Pest and disease identification and control
- Lawn care, mowing, and edging
- Pruning and hedge trimming
- Weeding and garden bed maintenance
3.2. Materials such as mulch, plants, and irrigation components are not included in the monthly service fee and will be quoted and charged separately.
3.3. Mulch is charged at $95 per cubic metre (plus GST) in addition to the monthly service fee. Mulching of garden beds may be performed during the Initial Clean Up (and quoted in the clean-up price) or as part of a regular monthly service.
4. Additional Visits and Works
4.1. From time to time, we may visit your property between scheduled services for additional work such as targeted spraying, seasonal treatments, or follow-up care. These visits are included in your monthly service at no extra charge.
4.2. While we will do our best to inform you of any additional visits in advance, we cannot always guarantee prior notice for these drop-in services.
4.3. If any major work is required, such as hard pruning, tree removal, or significant garden restructuring, we will notify you and obtain your approval before proceeding.
5. Pets and Safety
5.1. For clients with pets, we will ensure all doors and gates are securely closed behind us while we work and that pets remain safely within the property.
5.2. Dog owners are kindly requested to clean up after their dog before our scheduled arrival.
5.3. ABS Horticulture accepts no liability for injury caused by a client's pet to our staff, or for any pet that escapes the property due to circumstances beyond our reasonable control.
6. Pricing and Payment
6.1. All quoted prices are inclusive of GST unless otherwise stated.
6.2. Monthly service fees are invoiced at the beginning of each service period and are payable within 14 days of the invoice date.
6.3. Additional works, materials, and extras will be quoted separately and invoiced upon completion.
6.4. ABS Horticulture reserves the right to review and adjust pricing with 30 days' written notice. Any price changes will apply from the next billing cycle following the notice period.
7. Cancellation and Termination
7.1. Either party may terminate the service agreement by providing 30 days' written notice.
7.2. If a scheduled visit needs to be postponed due to the client's request, please provide at least 48 hours' notice. Visits cancelled with less than 48 hours' notice may be charged at the full service rate.
7.3. ABS Horticulture may suspend or terminate services immediately if payment remains outstanding for more than 30 days.
8. Liability and Insurance
8.1. ABS Horticulture holds public liability insurance and WorkCover for all team members.
8.2. While we take the utmost care on your property, ABS Horticulture's liability is limited to the cost of the services provided. We are not liable for pre-existing damage, natural plant decline, pest damage, weather events, or any damage arising from conditions beyond our reasonable control.
8.3. Any concerns about damage must be raised within 7 days of the service visit in question.
9. Communication
9.1. Our primary method of communication is SMS and phone. We will use the contact details provided at the time of engagement.
9.2. It is the client's responsibility to keep their contact details up to date and to respond to scheduling communications in a timely manner.

10. Governing Law
10.1. These terms and conditions are governed by the laws of the State of Victoria, Australia. Any disputes arising from these terms will be subject to the jurisdiction of the courts of Victoria.
10.2. If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
11. Changes to These Terms
11.1. ABS Horticulture reserves the right to update these terms and conditions at any time. Updated terms will be published on this page with a revised date.
11.2. Continued use of our services following any changes constitutes acceptance of the updated terms.
